1.Introduction
- These Terms & Conditions apply to all online orders placed through the Spot on Cakes website.
- By placing an order, you acknowledge that you have read and agreed to these Terms & Conditions.
2. Products
- Every cake is handcrafted to order.
- Due to the handmade nature of our products, slight variations in colour, decoration and finish may occur.
- Product images are provided as a guide only.
- Colours may vary slightly due to screen settings and edible colour variations.
- Seasonal flowers or decorations may be substituted with similar alternatives where necessary while maintaining the overall design.
3. Ordering
- Online orders close every Sunday at 12:00 pm (AEST) for collection or delivery the following weekend.
- Orders are confirmed once full payment has been received.
- Orders placed after the weekly cut-off will automatically roll over to the next available weekend.
- Spot on Cakes reserves the right to decline or cancel an order if necessary. If this occurs, a full refund will be provided.
4. Pricing & Payment
- All prices are displayed in Australian Dollars (AUD).
- Full payment is required at checkout.
- Payments are securely processed using the payment methods available at checkout, including Stripe and PayPal.
- Prices may change without notice; however, confirmed orders will not be affected.
5. Order Changes
- Please contact us as soon as possible if you need to make changes to your order.
- Minor changes may be possible before the weekly order cut-off.
- Once production has commenced, changes cannot be guaranteed.
- Collection or delivery date changes are subject to availability.
6. Cancellation & Refunds
- Cancellation requests must be submitted in writing via email.
- More than 14 days’ notice: Full refund, less any personalised items or special-order materials already purchased specifically for your order.
- 8–14 days’ notice: 50% refund.
- 7 days or less: No refund, as production has commenced or ingredients and production time have been allocated to your order.
- If Spot on Cakes is unable to fulfil your order, a full refund or an alternative collection or delivery date will be offered.
- Nothing in this policy limits your rights under the Australian Consumer Law.
7. Collection & Delivery
Collection
- Collection is available from our home studio in Jordan Springs, NSW.
- Collection is available during the following collection windows:
- Friday: 10:00 am – 6:00 pm
- Saturday: 9:00 am – 12:00 pm
- Your confirmation email will include the full collection address and your allocated collection day and time window.
- If you require a collection time outside these hours, please contact us before placing your order. While we’ll do our best to accommodate your request, alternative collection times cannot be guaranteed.
Delivery
- Delivery is available within a 50 km radius of our Jordan Springs studio.
- Delivery fees apply as follows:
- Up to 15 km: $15 flat rate.
- 15–50 km: $1 per kilometre.
- Beyond 50 km: Collection only.
- Delivery windows are estimates and may vary due to traffic, weather or other unforeseen circumstances.
- Delivery is available during the following delivery windows:
- Friday: 6:30 PM – 8:30 PM
- Saturday: 12:30 PM – 4:30 PM
- Customers will select an available delivery window when placing their online order.
- Someone must be available to receive the cake during the selected delivery window.
- Cakes will not be left unattended unless prior written permission has been provided.
- Additional delivery charges may apply if re-delivery is required.
- Please inspect your cake before accepting collection or delivery.
- Responsibility for the cake transfers to the customer once it has been collected or accepted at delivery.
8.Cake Care & Storage
- Cakes should be refrigerated until 1–2 hours before serving unless otherwise advised.
- Always transport cakes on a flat surface in an air-conditioned vehicle.
- Keep cakes away from direct sunlight and heat.
- Every order includes a Cake Care Instruction Card with transport, storage and serving information.
- For the best flavour and texture, enjoy your cake within 3–5 days of collection.
- Spot on Cakes is not responsible for damage resulting from failure to follow the Cake Care instructions provided.
9. Allergens
- Our kitchen handles gluten, dairy, eggs, soy and nuts.
- While every care is taken during preparation, we cannot guarantee an allergen-free environment.
- Customers with food allergies should consider this before placing an order.
- Ingredient information is available upon request.
10 . Internal Supports
- Some cakes may contain non-edible supports such as dowels, skewers, wires or cake boards for stability.
- These must be removed before serving and consuming the cake.
11. Product Variations
- Every cake is handmade and therefore unique.
- Minor variations in colour, decoration, piping and finish may occur.
- Any substitutions will be of similar style and quality while maintaining the overall design.
12. Customer Responsibilities
- Please ensure all spelling, dates and personalised information entered during checkout are correct.
- Please check your order confirmation carefully and notify us immediately if any details are incorrect.
- Ensure someone is available to receive your cake during the selected delivery window.
- Follow the Cake Care instructions provided.
- Spot on Cakes is not responsible for incorrect information supplied by the customer.
13. Intellectual Property
- All website content, photographs, logos, cake designs and written content are the intellectual property of Spot on Cakes.
- Images and content may not be copied, reproduced, published or used without prior written permission.
14.Limitation of Liability
- Spot on Cakes is not responsible for damage caused after collection or delivery, including incorrect transport, storage or handling.
- Spot on Cakes is not responsible for damage caused by transporting cakes in unsuitable vehicles or failing to follow the Cake Care instructions provided.
- Liability is limited to the maximum extent permitted under Australian Consumer Law.
15. Force Majeure
- Spot on Cakes will not be liable for delays or cancellations caused by circumstances beyond our reasonable control, including severe weather, natural disasters, power outages or other unforeseen events.
16. Privacy
- Your personal information is collected solely for the purpose of processing your order and communicating with you.
- We do not sell or share your personal information with third parties except where required to process your order or by law.
- Personal information is handled in accordance with Australian privacy legislation.
17. Serving Sizes
- Cake serving sizes provided on our website are intended as a guide only.
- Actual servings may vary depending on how the cake is cut.
